Kennel Farm Field: can You help prove a Right of Way ?

Many Warlingham residents have crossed Kennel Farm Field that lies between Farleigh Road, Harrow Road, Chelsham Road and Greenhill Lane for many years, but about six years ago the Field was fenced and last year “no trespassing” signs were erected. Following complaints from residents the Parish Council took up the matter with the owners of the Field, a group of charities, but they are unwilling to re-open it and wish to develop it for housing.

Councillor Charles Lister has investigated the situation including obtaining advice from the Surrey Rights of Way officer, the Open Spaces Society and the Ramblers Association, and concluded that it may be possible to establish a right of way across the Field on a specific discernible path running form Greenhill Lane to Harrow Road. However, to do this at least twenty residents need to sign a statement saying they used the path on a regular basis and, collectively, this needs to add up to consistent use over a 20 year period.

We are particularly keen to hear from anyone who used the path before 1997 when the owners first made a legal declaration that there was no right of way. But, to get the fullest picture, we also want hear from anyone who used it before 2012.

If you think you can help, please collect an evidence form and guidance notes from the Library or by printing them off from the link below. Return completed forms to the Library by 30 April, where there will be a special box to put them in. If you would like advice on completing the form, Cllr Lister and other parish councillors will be available in the Library on Saturday 17th March from 1.30 pm to 4 pm and on Tuesday 20th March from 2pm to 5 pm. Cllr Lister is also happy to answer questions directly. You can contact him at This email address is being protected from spambots. You need JavaScript enabled to view it. or on 07772 303689.
